frequently asked questions

Can children under the age of 18 inherit?
Children cannot inherit money, property or assets until they reach the age of 18. When a child is under this age, the funds will be held in Trust by the Executors/Trustees named in the Will.  If you feel that 18 is too young for your children to inherit a large sum of money, within a Will you can specify the age of inheritance to 21 or 25 years.
Can an Executor also be a beneficiary?
Yes, it's perfectly legal to make the executor of your will a beneficiary. Relatives and family friends can make good executors, but legal professionals have the time and expertise to settle an estate quickly and smoothly.
What happens if I do not make a Will?
Many people erroneously think that their Estate will go to their partner when they die. This is not necessarily the case. For example, an unmarried partner will be entitled to nothing. Even a spouse may not receive the entire Estate, and worryingly, may not receive enough to maintain their current lifestyle.
